Storage Auctions, Terms & Conditions for Sale


The following terms and conditions apply to the typical storage unit auction conducted by Severn River Auctions.  The Storage Operator may add other terms and conditions, furnished by the Operator on the Buyers Sign In Sheet or announced by the Auctioneer before the sale.  If there is a conflict between the Terms and Conditions listed below and Term and Conditions distributed or announced before the sale, the ones distributed or announced before the sale will prevail.   1. All units are sold AS IS, WHERE IS, with no warranties expressed or implied.  All sales are final, no returns or exchanges.
  2. Bidders must be 18 years of age, and must sign in.  An Auction bid accepted by the Auctioneer is a Contract For Sale, which is terminated by a higher bid.  The Contract created by the acceptance of the bid is not complete until payment, in full, is made by the bidder.  Children under 18 are not allowed beyond the office.
  3. The Auctioneer does not usually accept "cut bids," or bids in a smaller amount of increase than the Auctioneer is asking.  The Auctioneer reserves the right to reject any bid, in any amount for any reason.
  4. Self-Storage Operators (the "Operators') are selling at a public sale the contents of certain self storage units for the non-payment of rent, and other charges and fees, at their facilities, as per the regulations of the state and local jurisdiction where the facility is located.
  5. Tenants in default have the right to pay for the balance in full before their unit is auctioned.
  6. Tenants or anyone acting as their agent (including family and friends) are not allowed to bid, and this is a violation of most state regulations and there are civil penalties for violations.
  7. Operators and/or Severn River Auctions (the "Auctioneer") reserve the right to withdraw from sale any unit(s) or to cancel the sale for any reason, without notice for any reason whatsoever.
  8. The sale may include abandoned units or units surrendered by tenants, including motor vehicles, trailers, and watercraft stored on the premises.
  9. No photography, still or action, video or audio taping of the auction is allowed without the express, written permission of the Operator and "undercover" recording is illegal in many states.
  10. A limited period of visual inspection will take place before the auction.  Bidders may not enter the units or attempt to open boxes, containers, bags, etc., within their reach.  Any one removing an item before or during the auction is subject to the penalties for shop lifting.
  11. Units are sold to the highest bidder.  Bids receive after the units is sold are void.
  12. Payment is in cash, US dollars, due immediately after the sale.
  13. State Sales Tax applies to all purchases in most jurisdictions, unless you have a sales tax exemption certificate, which must be presented to avoid paying sales tax.
  14. If a Buyers Premium is charged, it will be announced before the sale.
  15. Some facilities require a refundable clean-out deposit per unit.  If so, it will be announced before the sale.
  16. Buyers have 24 hours to remove the contents, including trash and remove same from the premises.  Units must be boom cleaned.  Please return personal items, such as family photographs, items with social security numbers, etc.
  17. The auctioneer will follow the published schedule.  In case of cancellations, the schedule will proceed unchanged.  Units can not be sold before the advertised time.
  18. Buyers who fail to clean-out their units within the time-limits, fail to pay all charges, will be banned from future sales.
  19. Additional Term and Conditions may be announced before the sale.
